The State Council of Education, Research and Training (SCERT), Delhi has complied with the recommendations of the National Human Rights Commission to allow 20 minutes per hour extra time to the disabled (PH) examinees taking assistance of a writer.
In response to the recommendations of the Commission, the SCERT, in a communication dated 17th September, 2010, informed that provision for extra time to disabled examinees will be implemented for the forthcoming examinations scheduled to be held in April-May, 2011 onwards.
The SCERT also informed that the examinations for the year 2010 were almost over by the time recommendations by NHRC could not be implemented. However, it allowed 20 minutes per hour extra time to the disabled examinees for the reappear examination.
The Commission took up the issue on a complaint filed by one Ankit Gautam on the 10th May, 2010. In his complaint he prayed for urgent intervention of the Commission for the direction to the Director/Examination Controller of SCERT, Delhi to allow him an additional hour for the written test to be held from 14th May, 2010 as he was disabled.
In this connection, he also drew attention of the Commission towards a circular dated 2nd August, 2000 issued by the Chief Commissioner for Disabilities, Ministry of Social Justice and Empowerment on modifications in the Schools/Colleges examination entrance tests and written tests for recruitment to jobs and promotion and for interviews for persons with disabilities.
The Commission vide its proceedings on 10th May, 2010 issued a notice to the Director, SCERT for consideration and to ensure that there is no violation of complainant's human rights and sought an action taken report within three days.
The Controller Examination, SCERT, in his report dated 13th May, 2010 revealed that the complainant was allowed half an hour extra time along with a writer for the examination. In another report, the SCERT informed that the matter for granting one hour extra time to the disabled candidates will be looked into by its examination advisory committee.
The Commission in the spirit of the Section 31 of the 'Persons with Disabilities (Equal Opportunities, Protection on Rights and Full Participation) Act, 1995, further observed on the 28th May, 2010, that for a written test of one hour duration, at least 20 minutes extra time should be allotted to disabled candidates taking assistance of a writer.
It also said that extra time should be worked out on the basis of 20 minutes per hour criteria for written tests involving more than one or less than one hour. The Commission recommended that the Controller Examination, SCERT, Delhi issue necessary guidelines for the benefit of all persons with disabilities.
On compliance of this recommendation by the SCERT, the Commission directed that all the Chief Secretaries of the State Governments be informed about the appreciable action taken by the SCERT, Delhi so that they may also take similar action to accommodate the disabled students/candidates.
