Charter of Common Demands of CGEs.

The representatives of AIRF, AIDEF, Confederation met at AIRF Office today under the Chairmanship of Com. Umraomal Purohit. President, AIRF. The following Comrades were present.

The meeting decided to forge a Joint Council of Action to pursue the enclosed Charter of Common Demands of CGEs. Com. Umraomal Purohit President AIRF will be the Chairman and Com. Shiv Gopal Mishra will be its Convenor. The following shall be the members of the Council.

The following demands were included in the Common Charter of demands:

1. Set up the 7th CPC and frame its terms of reference after consultation with Staff Side.
2. Merge DA with pay for all purposes.
3. Scrap the New Contributory Pension Scheme.
4. Regularize (a) Gramin Dak Sevaks of Postal Department.(b)Daily rated workers , (c) Contract Labourers:
5. Remove 5% Ceiling on Compassionate appointments.
6. Settle all 6th CPC anomalies raised in the National Anomaly Committee and implement the Arbitration Awards.
7. Remove Ceiling of Rs. 3500 on computation of Bonus.
All organizations may include the department –specific and other demands in Part B of the Charter and seek settlement thereof with the appropriate authorities.

The meeting also decided to submit the Charter of demands to the Cabinet Secretary and seek negotiated settlement.

The Council will meet again in the first week of August 2013 to decide upon the date of National Convention and other programmes of action in pursuance of the Charter of demands.

Confederation Secretary has informed that the Joint meeting with the leaders of AIRF (Railway), AIDEF (Defence) has been postponed to 29th June, 2013, which was originally scheduled to be held on 15.6.2013.

                We invite your attention to the  efforts undertaken by us after the 12th December, one day strike action to bring about a united action by the Railway, Defence and other Central Government employees on certain pressing demands.  In this connection you will recall that Com. S.K. Vyas, our President had been writing and following it up with telephonic conversations to bring about such a platform for action. We are happy to inform you that the AIRF and AIDEF has now agreed to bring about a joint platform of action to project two important demands of the CGEs. Viz. the setting up of the 7th CPC and the withdrawal of the PFRDA Bill.
 
                We send herewith the joint Circular letter issued by the three organizations on 23.3.2013 calling upon its units to organize a joint demonstration on 29th April, 2013 in front of all offices throughout the country.  The affiliates and State Committees are requested to take initiative in organizing the programme with maximum participation of members of the three organizations at a mutually agreed Central place in all Cities/towns and other places.  All Units should be requested to send the telegram to the Prime Minister and a report of the extent of participation sent to the Confederation CHQ by 3rd May, 2013.  We shall review the participation in the programme at our National Conference at Kolkata.

As  you are aware, the Government in reply to a question raised in the Parliament has stated that setting up of the 7th Central Pay Commission  for effecting wage revision of central Government employees is not presently under its consideration.  You will recall, that  a similar statement was made by the then Finance Minister, when the demand for setting up the 6th CPC was raised by the employees.  The Joint movement of the Central Government employees, for which we created the platform of the Steering Committee of the organizations participating in the JCM under the leadership of Late Com. J.P. Chaubey, the then General Secretary of All India Railway men Federation could ensure that the Government rescind its stand then and set up the 6th CPC.  The real value of wages determined by the 6th CPC has now been eroded to the extent of above 100% due to the unprecedented inflation in the economy and spiraling rise in the prices of essential commodities.  While the Government permits wage negotiation and revision in the fully owned Public Sector Undertakings every five years, the denial to revise the wages of Central Government employees despite such large scale erosion in the real value of wages is absolutely unjustified.
 
The Government had been persisting with the enactment of the PRFDA Bill in the Parliament in almost all sessions ever since the UPA II Government took over.  Ironically they could elicit support from the main Opposition Party in the country for this ill advised enactment.  Lakhs of new workers who have joined in various organizations of the Government since2004 are worried of their future, which is forlorn and bleak, in the wake of the denial of an age old social security scheme of Pension.  We have been together opposing this move right from the day, the NDA Government introduced the bill in the Parliament in 2003.  However, our efforts, actions and objections have all been ignored with disdain by the Government. Though they could not muster enough support required to pass the bill in the Parliament, the Union Cabinet has recently taken the decision to allow 49% FDI in the pension fund.
 
We are to channelize our efforts through a wider platform of Unity. Efforts are on anvil to bring about such a platform.  In the meantime, we have decided to call upon all Units and Branches of AiRF, Confederation and AIDEF to organize Demonstration on 29th April, 2013. in front of all offices and send the following telegram to the Prime Minister.

What will happen DA reaches 100%..!

At present DA is getting ready to touch 80% level. We can expect that it will reach to 100% level near future.

Dearness Allowance Vs Price Rise

The central government employee’s confederation opined that The Dearness allowance which the cg employees are receiving now is not enough to meet the price rise of essential commodities. (see here)

The retail price of those commodities which go into making of minimum wage have risen by about 160% between 1.1.2006 to 2011 in comparison to D.A. compensation, which on the date had been just 51%

The effect of 50% Dearness allowance on our Pay

The sixth pay commission recommended that Whenever the DA reaches 50% level , Some allowances have to be increased by 25 % . Where as in Fifth CPC , it had been recommended when the DA reaches 50 % it should be merged with Basic Pay. It has been implemented with effect from 2004. And the fifth cpc also recommended that the Pay and Allowance should be revised after every five years. But it was not accepted by the Government.

The objectives of increasing Allowances by 25% as per the 6 CPC or merging DA with Basic pay as in the case of 5CPC, when ever DA reaches 50%, is to make the central government employees to balance the financial burden caused by Price Rise through increasing their pay package.

The impact of DA Reaches 100%

According to fifth CPC the 50 % DA had been merged with Basic Pay and in 6CPC , some allowances have been increased by 25%. But 5CPC didn’t say anything about what should be done when DA touch 100% level. Because the govt servants receiving their pay as per pre revised pay were not granted merging of another 50% of DA in 5CPC scale.

7th Pay commission

Even after the rate of DA is increased to 50% level it is not enough to increase some allowance by 25% as it will not help to handle the expenses caused by inflation. So The central government employees are expecting that government should constitute 7th pay commission immediately.

7th pay commission news -Maken backs demand for 7th pay panel

In a move aimed at putting the demand for the 7th Pay Commission on the government's drawing board, Union minister Ajay Maken has asked Prime Minister Manmohan Singh to set it up this year to neutralise the effect of soaring inflation.

His demand this week is the first voice in support of the panel from within Singh's cabinet.

Seventh Pay Commission Must Be Set Up Forthwith-IRTSA

SEVENTH PAY COMMISSION MUST BE SET UP FORTHWITH
The recent statement of the Minister concerned in the Parliament, that the Govt does not propose to set up the seventh Pay Commission at this stage is most unjustified and frustrating for the Govt employees.


Fifth Pay Commission had recommended for a Pay Revision after every five years instead of the past practice to set it up after 10 to 13 years. But the Govt did not accept this recommendation.


The Fifth Pay Commission also recommended for Merger of DA after it crossed 50%. Govt accepted the same and belatedly implemented it from April 2004. But the Sixth Pay Commission did not favour even the Merger of DA after it crossed 50% and the Govt obvious followed suit and did not Merge the same when it crossed 50% in 1-1-2011 - in spite of the demand by all concerned.


As such, the existing Pay and Pension structure have lost all the relevance and is continuously eroding due to heavy inflation and defective system of compilation of Price Index - which itself is out dated due to the changed economic scenario and requirements of the Industrial Worker of the Country.


All this makes it essential that the Seventh Pay Commission be set up early to compensate for the erosion of real wages and to remove the serious Anomalies of Sixth CPC Report - which the Govt and the Anomalies Committee have failed to address as well as to bridge the vast gap of wages between the Government employees and those of the Corporate Sector etc. all which are having a very demoralising effect amongst the Govt employees and Pensioners.

(a) & (b) :    The Sixth Central Pay Commission did not make any specific recommendation regarding constitution of the Seventh Central Pay Commission.

(c) to (e) :    The recommendations of the 6th Central Pay Commission pertaining to the existing scales of pay in case of Central Government employees were given effect to from 1.1.2006. Generally, there has been a gap of a minimum 10 years between two successive Pay Commissions. Therefore, no proposal to constitute the Seventh Central Pay Commission is at present under consideration.

Admitting that there have been demands for setting up of 7th Pay Commission, government said that no such proposal is under consideration for such exercise, which would have been resulted in upward revision of centre's over 85 lakh employees' and pensioners' pay scales.

"The recommendations of the previous .. 6th Central Pay Commission were given effect to from January 1, 2006. Therefore, at present no proposal to constitute the 7th Pay Commission is under consideration of the government," Minister of State for Finance Namo Narain Meena told Lok Sahba on Friday in a written reply.

People may think that the babus again started to make voice over pay revision and next pay commission or 7th Pay commission. There is a saying that “The crying baby gets the milk”. The need makes the man to act.


One should try to understand the fact that being a government servant one can witness a considerable pay hike at least twice or thrice of his/her entire service period. Because, other than promotion, only the pay commission recommendation will give them considerable pay hike. But it takes place once in ten years. Now a days a government employee can render service 20 or 30 years only due to non availability of employment opportunity in government service below the age of 25. So there is no need to be get annoyed by hearing the voice for seventh pay commission from central government employees. Because constituting next pay commission is for nothing but to review the salary of the govt. servants with the current economical condition of the country.


How the pay of a govt. employee had been fixed at the beginning of the Independence India.


Till now there are six pay commission had been constituted to review and recommend pay structure of central government employees.


All the six pay commissions have taken many aspects into consideration to prescribe the pay structure for government servants.


In the first pay commission the concept of ‘living wage’ was adopted.


In second pay commission it had been reiterated that the pay structure and working condition to be crafted in a way so as to ensure the effective functioning of government mechanism.


The third pay commission adopted the concept of ‘need based wage’


The Fourth CPC had recommended the government to constitute permanent machinery to undertake periodical review of pay and allowances of Central Government employees, but which got never implemented.


In Fifth pay commission all federations demanded that the pay scale should be at par with the public sector. But the pay commission didn’t accept this and told that the demand for parity with the Public Sector was however difficult to concede as it felt that the Job content and condition of service in the government and pulic sector not necessarily the same. There were essential differences between the two sectors.


The Sixth Central Pay Commission, claimed that it had not only tried to evolve a proper pay package for the Government employees but also to make recommendations rationalizing the governmental structure with a view to improve the delivery mechanisms for providing better services to the common man


What about seventh pay commission?


Generally every pay commission, before recommending a pay structure, it used to analyze all the aspects including the economic situation of the country, financial resources of the government, comparison with the public sector, private sector and state government pay structure etc. So it is very much clear that Pay Determination is very complicated and sensitive task. Without any doubt every one accepts that this is very challenging task too. In order to determine the new pay structure the pay commission has to go through voluminous data consisting current economic condition, strength of the work force and working condition etc. In the meantime, if one tries to suggest or comment about 7thy pay commission pay scale or about what the seventh pay commission pay scale would be, it will not get much importance.


But when we come across all the recommendations of six pay commissions, we observed an interesting factor which is common to all the pay commission recommendations, particularly in the matter of percentage of increase in the pay. Average 3 times increase in the pay was recommended by each pay commission and it was accepted by government and implemented. We have posted three articles about six pay commissions before this post.

Short Description about Sixth Pay Commission


Obviously it is simple thing, we can say it a mathematical coincidence that we have in common in all previous pay commission, but we cannot neglect this. Because it was there, every time it is noticed that the revised pay was approximately three times higher than its pre revised pay. Apart from all the factors which has been used to determine the pay revision, we can use this simple formula ‘common multiplying factor’ to know the 7th pay commission pay scale . If next pay commission prefer to continue the same running pay band and grade pay system for seventh pay commission also, the pay structure may be like the following projected figures given below, using common multiplying factor ‘3’. VII CPC : Short Description about Sixth Pay Commission

Before discuss about the VII pay commission let us see about sixth pay commission…

SIXTH PAY COMMISSION

Initially the then government refused to set up sixth pay commission to review the pay and allowances of central government employees. The then finance minister told that there was no need to constitute next pay commission since 50 % dearness allowance was already merged with the basic pay. The employees had threatened to go on a nationwide strike if the government failed to set up 6th pay commission. In July 2006, the Cabinet approved setting up of the sixth pay commission. This commission has been set up under the Chairmanship of Justice B.N.Srikrishna with a timeframe of 18 months to submit the report. The cost of hikes in salaries is anticipated to be about Rs. 20,000 crore for a total of 3.5 million government employees. The commission submitted the Report to the Government on March, 24, 2008.

The Sixth Pay Commission mainly focused on removing ambiguity in respect of various pay scales and mainly focused on reducing number of pay scales .It recommended for removal of Group-D cadre.

The Fifth CPC had compressed many scales. The number of pay scales was reduced from 51 pay scales as on 31.12.1995 to 34 pay scales by the Fifth CPC. In many cases, this led to the promotion and feeder cadres being placed in an identical pay scale. Although Department of Expenditure issued orders that existence of the feeder and promotion posts in the same pay scale will not constitute an anomaly, however, these orders have consistently been rejected by the various courts of this country. The sixth pay Commission, therefore, decided to evolve a new system of pay scales that would effectively address most of the existing anomalies.

To remove stagnation, introduction of running pay bands for all posts in the Government presently existing in scales below that of Rs.26,000 (fixed).

The total number of grades reduced to 20 spread across four distinct running pay bands; one Apex Scale and another grade for the post of Cabinet Secretary/equivalent as against 35 standard pay scales existing earlier.

Four distinct running pay bands being recommended – one running band each for all categories of employees in groups ‘B ’and ‘C ’with 2 running pay bands for Group A posts.

Annual increments to be paid in form of three percent of the total of pay in the Pay Band and the corresponding grade pay. The date of annual increments, in all cases, is first of July. Employees completing six months and above in the scale as on July 1 will be eligible.

The revised pay bands have been implemented retrospectively from 1.1.2006. The Fifth CPC also had recommended implementation of the next Pay Commission’s revised pay scales from 1.1.2006. This was also in consonance with demands of a majority of the Associations of Government employees that had sought implementation of Sixth CPC revised pay scales from 1.1.2006.

Minimum salary at the entry level of PB-1 pay band is Rs.7000 (Rs.5200 as pay in the pay band plus Rs.1800 as grade pay). Maximum salary at the level of Secretary/equivalent is Rs.80000. The minimum: maximum ratio 1:12. The increase from V CPC to VI CPC in all grades starts from 2.4 times to 3.7 times. The increase ratio between 5th pay commission and 6th pay commission is 1:3
