Subject : Self-certification


The Second Administrative Reforms Commission in its 12th Report titled "Citizen Centric Administration - The Heart of Governance", has recommended, adoption of self-certification provision for simplifying procedures. (www.darpg.gov.in)

2. Taking a cue from this some Ministries / State Governments have adopted the provision of self-certification of documents like marksheet, birth certificate etc. by the applicants / stakeholders instead of asking for an attested copy of the documents by a Gazetted Officer or filing of affidavits. Under the self attestation method, the original documents are required to be produced at the final stage.

3. You will appreciate that the above method is citizen friendly and obtaining either an attested copy or affidavit not only cost money but also involves wastage of time of the citizens and the Government officials.

3. It is requested to kindly review the existing requirements of attested copy or affidavit in various application forms in a phased manner and wherever possible make provision for self-certification of documents, after obtaining the approval of the competent authority.

Subject : Guidelines regarding grant of vigilance clearance to members of the Central Civil Services/Central Civil Posts.

The undersigned is directed to refer to this Department’s O.M. of even number dated 14.12.2007 on the above subject and to say that it has been decided to modify Para 2(c) thereof as under:

"(c) Vigilance clearance shall not be withheld unless (i) the officer is under suspension (ii) the officer is on the Agreed List, provided that in all such cases the position shall be mandatorily revisited after a period of one year (iii) a chargesheet has been issued against the officer in a disciplinary proceeding and the proceeding is pending (iv) orders for instituting disciplinary proceeding against the officer have been issued by the Disciplinary Authority provided that the chargesheet is served within three months from the date of passing such order (v) chargesheet has been filed in a Court by the Investigating Agency in a criminal case and the case is pending (vi) orders for instituting a criminal case against the officer have been issued by the Disciplinary Authority provided that the chargesheet is served within three months from the date of initiating proceedings (vii) sanction for investigation or prosecution has been granted by the Competent Authority in a case under the PC Act or any other criminal matter (viii) an FIR has been filed or a case registered by the concerned Department against the officer provided that the chargesheet is served within three months from the date of filing / registering the FIR / case (ix) the officer is involved in a trap / raid case on charges of corruption and investigation is pending."

Sub: Grant of family pension and gratuity to the eligible member of the family of an employee/pensioner/family pensioner reported missing consolidated instructions - regarding.

The provisions regarding grant of gratuity and family pension to the members of families of the deceased Government servants/pensioners who were appointed on or before 31st December, 2003 and who are/were born on pensionable establishments are contained in Rules 50-54 of the Central Civil Services (Pension) Rules, 1972. The instructions regarding grant of family pension and gratuity under these rules to the eligible member of the family of an employee reported missing had been issued vide this Departments earlier office memorandum No.1/17/86-P&PW, dated 29th August, 1986. Clarifications amendments in this regard were issued vide OM No. 1/17/86-P&PW, dated 25th January, 1991 and 18th February, 1993 and OM No. 1/28/04-P&PW(E) dated 31st March. 2009 and  2nd July, 2010.O.M. of even number, dated 14th September, 2011 and OM No. 1/17/2010-P&PW(E), dated 2nd January, 2012.

2. A reference has been received in this Department to clarify whether in a situation where SHO gates that FIR is not required to be lodged in the case of person gone missing, the eligible member of the family can be granted family pension. The matter has been examined in consultation with the Ministry of Home Affairs. Section 154 (1) of the Criminal Procedure Code mandates filing of an FIR by the Police authorities on a report received of the commission of a cognizable offence. A missing person per se does not point to commission of a cognizable offence. In view of this. cognizance of a person's disappearance can be taken by the Head of Office on the basis of an authenticated Daily Diary (DD) General Diary Entry (GDE), filed by the Police authorities concerned, as per the practice prevalent in that State/UT.


3. It has now been decided to issue consolidated instructions in supersession of previous instructions regarding grant of family pension to the eligible members of family of the employee/pensioner/family pensioner reported missing and whose where about are not known. It includes those kidnapped by insurgents/terrorists but does not include those who disappear after committing frauds/crime etc.

3. In the case of a missing employee/pensioner family pensioner, the family can apply for the grant of family pension, amount of salary due, leave encashment due and the amount of GPF and gratuity (whatever has not already been received) to the Head of Office of the organisation where the employee pensioner had last served, six months after lodging of Police report. The family pension and or retirement gratuity may be sanctioned by the Administrative Ministry/Department after observing the following formalities:-

(i) The family must lodge a report with the concerned Police Station and obtain a report from the Police, that the employee/pensioner/family pensioner has not been traced despite all efforts made by them. The report may be a First Information Report or any other report such as a Daily Diary General Diary Entry.

(ii) An Indemnity Bond should he taken from the nominee dependents of the employee/pensioner/Family pensioner that all payments will be adjusted against the payments due to the employee/pensioner/family pensioner in case she/he appears on the scene and makes any claim.

5. In the case of a missing employee, the family pension, at the ordinary or enhanced rate, as applicable, will accrue from the expiry of leave or the date up to which pay and allowances have been paid or the date of the police report. whichever is later. In the case of a missing pensioner family pensioner, it will accrue from the date of the police report or from the date immediately succeeding the date till which pension’ family pension had been paid, whichever is later.

6. The retirement gratuity will be paid to the family within three months of the date of application. In case of any delay, the interest shall be paid at the applicable rates and responsibility for delay shall be fixed. The difference between the death gratuity and retirement gratuity shall be payable after the death of the employee is conclusively established or on the expiry of the period of seven years from the date of the police report.

7. Before sanctioning the payment of gratuity, the Head of Office will assess all Government dues outstanding against the employee/pensioner and effect their recovery in accordance with Rule 71 of the CCS (Pension) Rules, 1972 and other instructions in force for effecting such recoveries.

8. The amount of salary due, leave encashment due and the amount of GPF will be paidly the family in the first instance as per the nominations made by the employee/pensioner on filing of a police report and submission of an indemnity bond as indicated above. 

9. The benefits to be sanctioned to the family nominee of the missing employee/pensioner will be based on and regulated by the emoluments drawn by him / her and the rules orders applicable to him / her as on the last date he / she was on duty including authorised periods of leave.

10. Formats of separate Indemnity Bonds to be used in the case of missing employees, missing pensioners and missing family pensioners are available at this department's website www.persmin.nic.in.

The undersigned is directed to refer to D/o Agriculture & Cooperation OM No. 22013/2013-F.I dated 30th May, 2013 vide which they have requested to circulate the vacant posts of Section Officer and Assistant in the Directorate of Marketing & Inspection located at Faridahad & Nagpur and Directorate of Plant Protection Quarantine & Storage at Faridabad among all Cadre Units of CSS. As these posts are outstation posts, they are required to be filled up in terms of guidelines laid don in DOP&T's OM No. 21/2/2009-CS.I(P)  dated 5th October, 2012.

2. The Cadre Units of CSS are, therefore, requested to forward applications along  with the personal particulars in the enclosed format in respect of willing Section Officers / Assistants of CSS for being considered to the aforesaid vacancies by 12th July, 2013  positively. Subject:Filling up backlog vacancies reserved for Scheduled Castes (SCs)/Scheduled Tribes (STs)/Other Backward Classes (OBCs).

A Special Recruitment Drive for filling up of the backlog vacancies reserved for SCs/STs/OBCs had been launched in November, 2008 and was concluded on 31st March, 2012.

2.    Achievement of the Drive as reported by various Ministries / Departments on its conclusion revealed that out of total 75,522 identified backlog vacancies , there were 64,175 backlog vacancies which could be filled up and of these, 48035 vacancies were filled up. Overall success rate of the Drive was 74.85%. Reasons for non-filling up of reserved vacancies may be attributed to the lack of finishing skills like English fluency or interview skills, non availability of qualified reserved category candidates for posts requiring professional qualification especially in ST category, scarcity of qualified reserved category persons results in job switch over or not joining after selection as they get better jobs and in some cases selection is done on all India basis whereas allocation is made zone/State wise.

3.    The Government considered the status of filling up of backlog vacancies reserved for SCs/STs/OBCs and desired that concerted efforts be made to fill up the backlog vacancies at the earliest and the status of action taken in this regard be monitored at the highest level. Besides, actions on the following measures are to be taken at the earliest to enhance the employability of reserved category candidates:

(i)    In order to fill up the vacancies in the posts requiring professional qualifications, the concerned Ministries/Departments may take a decision within a period of six months on launching of a Special Recruitment Drive providing certain relaxations so that the vacancies may be filled up;
(ii)    Finishing training should be imparted to the reserved category candidates once they complete technical/professional qualifications. Ministry of Social Justice and Empowerment and Ministry of Tribal Affairs would devise such programmes. Such programmes should be ,implemented with involvement of State and State Administrative Training Institutes.
(iii)    Training programmes for interview skills and English proficiency may also be devised for reserved category persons for posts requiring non-professional qualifications;
(iv)    The issue of providing reserve list/wail list of successful reserved category candidates would be taken up with the Recruitment Agencies so that in a situation when reserved category candidates with higher merit do no join the post, the post may be filled up from the candidates available in the reserved list;
(v)    The issue of less employability of SCs/STs/OBCs and Persons with Disabilities for Government sector may require in-depth analysis of the causes and to suggest remedial measures. It would be appropriate to constitute a Committee with representations from Ministry of Social Justice and Empowerment, Ministry of Tribal Affairs, Department of Personnel and Training, major Ministries /Departments like Ministry of Home Affairs, Ministry of Railways and government recruitment agencies. The committee should find out specific reasons for backlog in filling up of vacancies and suggest measures to enhance the employability of reserved category candidates.
(vi)    More and more posts may be identified for the persons with disabilities. Micro
specifications    may    be    made    liberal    by    providing    reasonable
accommodation/technological help.
(vii)    Schemes may be launched for establishment of inclusive schools/colleges where even persons with disabilities may be able to get education so that the dearth of qualified persons especially in Hearing Impaired category may be taken care of.
(viii)    As regards awareness of opportunity for the Persons with Disabilities, the Non- Government Organisations (NG0s) working in the concerned area may be roped in by the Department of Disability Affairs for dissemination of information about schemes/programmes/job opportunities.

4. All the Ministries /Departments are requested to take follow up action on the decision taken by the Government. Quarterly reports be sent to this Department for monitoring the progress of implementation of these directions.

Launching of Web Based software solution for Cadre Management of CSS - Requests for cadre clearance and filing of Immovable Property details reg.

Subject: Launching of Web Based software solution for Cadre Management of CSS - Requests for cadre clearance and filing of Immovable Property details reg.

As Ministries/ Departments are aware that the Web Based Cadre Management system for CSS is currently hosted at http://10.21.145.125

2. Verification of data Nodal officers for the Web Based Cadre Management are once again requested to verify the data in respect of all CSS Officers posted in the Ministries/ Departments concerned to ensure that complete data in respect of each and every CSS officer is available in the system. Nodal officers who have not yet obtained user id and password are again advised to furnish their details at email id: wbcm-dopt@nic.in so that these could be emailed to them. Individual CSS Officers are also advised to verify their data by logging in to the system with the user id which is a combination of eight digit date of birth followed by first four letters of their name i.e.: ddmmyyyyabcd. The common password is apple 123. As complete data particularly promotion and experience details are necessary to effectively use the system for cadre management activities, active cooperation of all CSS officers is requested.

3. Cadre clearance for deputation Ministries / Departments are again requested to forward applications for cadre clearance for deputation through the web based cadre management system also.

4. Voluntary Retirement Application seeking voluntary retirement should also be filed through the system. A print out of the copy of the application is required to be taken, duly signed and submitted to the nodal officer for processing. The nodal officer will forward the application online to this Department for further processing in respect of US and above level officers.

5. Immovable Property Return All CSS Officers are also requested to file their immovable property return through the web based system also, in addition to the conventional method of filing of paper returns.

6. APAR monitoring As reporting of APARS will be monitored through the web based cadre management system nodal officers concerned are once again requested to feed necessary details in the system prior to issue of forms to the individual employees for 2012-13 and also regularly update the progress in the system for effective monitoring of completion of APAR.

7. Ministries / Departments are requested to bring this circular to the notice of all CSS Officers.

Unauthorised absence – Consolidated instructions

Subject:-    Consolidated instructions relating to action warranted against Government servants remaining away from duty without - authorisation/grant of leave — Rule position

The undersigned is directed to say that various references are being received from Ministries/Departments seeking advice/post facto regularisation of unauthorised absence. It has been observed that due seriousness is not being accorded by the administrative authorities to the various rule provisions, inter alia under the CCS(Leave) Rules, 1972, for taking immediate and appropriate action against Government servants staying away from duty without prior sanction of leave or overstaying the periods of sanctioned leave. It is reiterated that such absence is unauthorised and warrants prompt and stringent action as per rules. It has been observed that concerned administrative authorities do not follow the prescribed procedure for dealing with such unauthorised absence.

2. In view of this, attention of all Ministries/Departments is invited to the various provisions of the relevant rules, as indicated in the following paragraphs for strict adherence in situations of unauthorised absence of Government servants. It is also suggested that these provisions may be brought to the notice of all the employees so as to highlight the consequences which may visit if a Government servant is on unauthorised absence. The present OM intends to provide ready reference points in respect of the relevant provisions, hence it is advised that the relevant rules, as are being cited below, are referred to by the competent authorities for appropriate and judicious application. The relevant provisions which may be kept in mind while considering such cases are indicated as follows:

(a)    Proviso to FR 17(1)

The said provision stipulates that an officer who is absent from duty without any authority shall not be entitled to any pay and allowances during the period of such absence.

(b)    FR 17-A

The said provision inter alia provides that where an individual employee remains absent unauthorisedly or deserts the post, the period of such absence shall be deemed to cause an interruption or break in service of the employee, unless otherwise decided by the competent authority for the purpose of leave travel concession and eligibility for appearing in departmental examinations, for which a minimum period of service is required.
 
(c)    Rule 25 of the CCS (Leave) Rules, 1972

The said provision addresses the situation where an employee overstays beyond the sanctioned leave of the kind due and admissible, and the competent authority has not approved such extension. The consequences that flow from such refusal of extension of leave include that:

i the Government servant shall not be entitled to any leave salary for such absence;

ii the period shall be debited against his leave account as though it were half pay leave to the extent such leave is due, the period in excess of such leave due being treated as extraordinary leave

iii wilful absence from duty after the expiry of leave renders a Government servant liable to disciplinary action.

With respect to (iii) above, it may be stated that all Ministries/ Departments are requested to ensure that in all cases of unauthorised absence by a Government servant, he should be informed of the consequences of such absence and be directed to rejoin duty immediately/ within a specified period, say within three days, failing which he would be liable for disciplinary action under CCS (CCA) Rules, 1965. It may be stressed that a Government servant who remains absent without any authority should be proceeded against immediately and this should not be put off till the absence exceeds the limit prescribed under the various provisions of CCS (Leave) Rules, 1972 and the disciplinary case should be conducted and concluded as quickly as possible.

(d)    Rule 32(6) of the CCS (Leave) Rules, 1972

This provision allows the authority competent to grant leave, to commute retrospectively periods of absence without leave into extraordinary leave under Rule 32(6) of CCS (Leave) Rules, 1972. A similar provision also exists under rule 27(2) of the CCS (Pension) Rules, 1972. It may please be ensured that discretion allowed under these provisions is exercised judiciously, keeping in view the circumstances and merits of each individual case. The period of absence so regularised by grant of extra ordinary leave shall normally not count for the purpose of increments and for the said purpose it shall be regulated by provisions of FR 26(b) (ii).

3.    All Ministries/ Departments should initiate appropriate action against delinquent Government servants as per rules.

            The undersigned is directed to refer to DOP&T’s OM No.21011/1/2009-Estt (A)- Part dated 16.08.2012 on the subject mentioned above and to inform that this Ministry has received 45 (approx) duly signed MOA from the hospitals situated outside Delhi/NCR for conducting proposed medical examination. A detailed list in this regard is attached.

 

            It is also informed that in Delhi/NCR, no new hospital has been empanelled for this purpose.
